It is VERY possible that there are exceptions for buildings of 4 or less units. 4 or less units qualify for FHA mortgages under a federal guideline - so perhaps the prohibitive New York legislation only applies to 5+ units?

Depending upon where you are in PA, zoning and land use may not be a problem, but apparently there are lots of hoa's that sue and or get sued as a result of common issues, so insurance can be crazy expensive or prohibitive.

Is the building simply in such bad condition that no one would pay higher rents and are your proposed higher rents in line with the rents in the area similar to what you propose in other words are they that far below market for similar units?
