It'll likely take us a few years to get it complete, but we'll hopefully get the rented portions ready early next year.We were originally looking at Market St. properties, but the ROI was quite low and the buy-in has gotten crazy over the past 5-8 years.

I’m basically getting all my money out of it to pay the HELOC off but ran into some issues with ratios because of my wife's student loans so a portion of the cash out needs to be allocated to pay off one of her loans which is fine by me!

That way we have a portion or all of the income guaranteed, we know we will pass inspection, and we have mitigated some of the risk that comes with the area.There is a lot more too it but.. in general understanding risk is a big part of investing.

So even if the homeowner worked out a deal (not negotiate down) to bring Heloc current (not paying entire balance due, just the portion in arrears plus all late fees and interest), could Heloc lender (2nd) still call the loan due once a subj to sale takes place?

If you're referring to the statewide law (AB1482) that went into effect January 1st, yes - the rent cap portion of the law applies to month to month tenants as well as those with leases over one year.

They may close it down and you wouldn't be able to use the untapped portion, though.Using a HELOC to buy cash and then refinancing to pay back (most) of the HELOC is a well worn strategy.
