You'd then pull a copy of the instrument and review it to decide if the instrument needed to be dealt with prior to closing, say to identify who should sign the deed or who needed to release a mortgage or lien or if it should appear as an exception on the commitment and policy.

You need to figure out who the lienholder is (it should be listed on the title -- if no title is in hand you'll need to order a duplicate from the DMV/MVA) then obtain a copy of the lien release.

The other issue is that if the ROBS owns the property, how do you release the cash to rollover to an IRA, but that point is really moot.

Assuming the lien was properly recorded and is not otherwise excepted or excluded from coverage, I expect the title insurer will attempt to confirm the violation has been corrected and then negotiate a reduction in the lien amount, and if it's less than the policy amount, pay it and obtain a record a release.
