The first applicant making requests is a big red flag, they could be very demanding and a huge PITA.The second appears to be a form of fraud but looks like you are renting to the daughter only.

It appears that the property is held within a partnership so the partnership would have to do the 1031 in this case(if you decide to go this route).If the property is sold outright - the gain(if any) is broken down into two components that is subject to depreciation recapture and that is subject to capital gain treatment.If the property is located in Florida and you are a Florida resident - you shouldn't be exposed to any state income tax upon sale.

As with anyone, read the fine print and ask what fees they not only charge you, but what they charge tenants for application fees, etc... sometimes companies shift costs to tenants (to appear cheaper to owners) and it only hurts the process.

As uncomfortable responding to what appears to be a fake profile, I'll say that you don't need a wet-ink copy to record a lien in the real property records - in Texas.
