For Use and Occupancy, that generally depends on the local laws.

If it is a HUD home do you have to be buy it as a owner occupant and not as an investor?

I have north of 60% occupancy and a much stronger cap rate than I could expect from long term rentals. 

Memphis, Dallas, Little Rock and Oklahoma City all have properties ready for immediate occupancy if needed.  

It could also be in the initial owner-occupant bid period that does not allow investor offers for a period of time.

This type of structure is rare but it seems like you have the opportunity to make it happen.If you don't have it in contract and increase the occupancy, it will be worth more and the seller will want a higher price if and when you are ready to buy

There are a few foreclosures I've been eyeing, however, very clearly states that buyer is responsible for any certifications, including Use & Occupancy, Certificate of Occupancy's, permits etc or anything else.
