As there is not enough space to build it on flat land with the normal slope setbacks, I understand that to take advantage of the "alternate setback" regulations, the setback would need engineering, and approval from the building department.

The property is in an R3 zone meets all the criteria for a 3-family under the revised zoning plan, but we are right on the fence with parking and landscaping requirements... so we'd like to work with architect who's done this kind of work before, specially since the implementation of the new Zoning and Land Use regulations last spring.  

State landlord tenant regulations clearly define how these situation are to be handled.

There are those who interpret the IRS regulations to mean that you can't even go over and change a light bulb, so be very careful about this.Secondarily, there are others who also cannot have any financial gain, including going over to change light bulbs, such as pretty much every family member you have.
