This should be clearly identified in the operating agreement for the syndication.

@Ashley Abbott I’d definitely have the partnership agreement drawn up by an attorney and having had two failed partnerships, one in real estate and one in a restaurant where the business and real estate was involved, make sure you have an exit strategy or strategies lined out in the agreement as this can be the most important part of the agreement.

They will need their full commission (as written in their listing agreement) plus whatever the seller agrees to accept as option consideration.

How you worded it will be the difference between one party being able to terminate the lease or both parties needing to be in agreement to terminate the lease.Personally, I would be pushing the tenant that wants to stay to leave.

Should I have each of them sign their own lease agreement, or just use one that has all three people listed as tenants? 

Make sure to check the lease agreement that they will let you do this.

Things can go wrong with larger projects really fast.Also, I can probably supply you an operating agreement as well if you would like for much cheaper than a lawyer.
