Unlawful Detainer - if a person stays on the property past their lawful right to do so, and refuses to leave when asked to do so, then in many jurisdictions an Unlawful Detainer can be filed in court.I suspect your attorney filed for Unlawful Detainer and that filing already shows up on his legal record.

None of my tenants has said they didn't receive it.I think the problem with sending it certified with a return receipt is most of the mail which is delivered by the USPS, deliver during the day when most people are at work.If my tenant doesn't respond to the pay or quit and I go to court to file the paperwork for summons for unlawful detainer, I have to raise my hand and swear that all notices were delivered to the tenant in accordance with the law.

Check your local laws regarding tenancy...... if she has been in there for quite awhile, the law in your state may still consider her a tenant even if not on the lease.....Start the eviction....get that ball rolling......and call the police for an unlawful squatter
