Two questions about this deal: (1) Since its our credit on the line b/c the mortgage stays in my name, we'd put a clause in that would allow me to foreclose on the house and get it back fully in my name if he misses two payments.

The fee they are charging you might be higher than the limit set in the law; the law might not require you to provide a copy of the lease; and they might not be able to assess, levy or charge a fee or fine or otherwise impose a requirement on a member's rental property any differently than on an owner-occupied property in the association.

If they aren't too bad, can use the money to get a mortgage, rent a room in your house and use that income to pay down the student loan, you may want to think about it.
