You may in fact be responsible for rent until the landlord can re-rent the unit, but the landlord also doesn't get to "double dip" (charge you 3 months rent if s/he rents it out in a month).In practical terms, you may have some leverage as far as mutually agreeing to end the lease, vs. forcing the landlord to evict you to regain possession of the unit, especially in the current environment when the eviction courts are quite backed up.I'm definitely not a lawyer, and you're asking a legal question, so I would urge you to consult one on this.

Locally when we file for evictions the courts (or their lawyers) order them to file for state aid, if they refuse the eviction moves forward.

You really do not want to start courting investors until you know the business intimately and until you know the numbers you do not know the business ie. values, CAP rates, Comps, Occupancies, Prevailing Rents, Rent growth, typical CapEx, OpEx, prop taxes, financing, SEC regs, Investor requirements etc.

If we end up in court will the judge see that this is in fact a "Just Cause" eviction based upon our correspondence and evidence and that I simply made a procedural error in not submitting the proper notice?

You can go the route of filing in court and hope that motivates him to pay, but it's likely just going to cost you more out of pocket with no positive result.I would tell the tenant what the right thing is, then wait.
