I had a lot of college kids, so parents co-signed, adults would get credit pulled, you can go over credit issues with an applicant so if there is an error claimed have them show its been corrected or cured.

If they do not personally get served or answer to go to court etc. then you can just get eviction here and not damages and would need to take them to small claims court.With your cold weather it sounds like leave the power on as you would be savings a few hundred to possibly lose thousands in repairs to your property.No legal advice.

The parents won't be living in the home and in order to be eligible for the STAR tax deduction...it must be your primary residence..They also already claim this exemption on their home which they still currently hold a mortgage on.

When you are all done send the son and the dad a bill and after about a week make a nice call to the dad and let him know you haven't been paid and would be going to small claims court to seek payment from him and his son.

If you're concerned about operating legally, my first thought is not to temp the watch dogs in the first place, having a deal blow up with a buyer is likely, if he shows up in court, (and no, he doesn't need an attorney like a guru claims) your deal will go under a microscope, why even go there if you're not forced into that position?

I negotiated with the Realtor to have them pay me $1k assignment fee and $1k down(they would pay 2k cash deposit either).The Deal did fall apart but the point of the story is that I learned that MLS properties could be sold and to retail buyers as long as the lender is not having to pay for the assignment fee.p.s. the deal fell aprt because the Broker was upset that they would be making a commission on $58k instead of $59k(yes for $1k)then the sellers fell out and the one i was dealing with quit claimed the deed over and got bought out by his partner.
