I would speak with the actual owner about it, and reference the law - possibly send it from a lawyer if it's worth your HOA's time and money.

I don't think anyone mentioned that if you stay highly leveraged on the properties or don't have any personal assets there isn't much "meat on the bone" for a lawyer to go after.
