I would go one step further and say that in this litigious country, you could be sued for virtually anything so if that is your primary concern when thinking of starting a new venture you have the wrong mental attitude about being in business.A good work around is disclose, disclose, disclose.

This "partner" has not performed their end of deal, has no interest in finishing projects, terrible with communication, and worst of all looks to be running some sort of scam with a contractor partner of his.I did a successful flip earlier this year with him, but things have drastically went down hill from there on the next ventures.

The IRA custodian will have direction of investment forms that the investor will need to complete and submit along with the documentation needed for the investment (i.e. mortgage, promissory note, private placement memorandum, joint venture agreement, etc.) in order to fund the transaction.
