The buyer should have the ability to cash out the senior loan with either a quick refi or CASH out of pocket .. if they dont or cant.. then well its just another situation that could end up in a real mess.

I'd see if I couldn't get back with the city and have them give a little justification, work with them telling them that the tenants will have to pay it, they might take a different view messing with that many citizens, if they are just looking at you, they are probably thinking- deep pockets, one vote, no brainer!
