If an existing lease is in place you can't require the tenant to sign your lease until the current lease period ends.

The property appraised for $465k and we cashed out $348k to pay back our PML and use the rest as a down payment toward the next deal, a 6-unit we have UC.

This had 1031 written all over it until the end where you can't get a loan.

Is that you or are you considering putting in a back-up offer. 

Per the original issue, circling back to confirm that I connected with a lawyer I've used before and they suggested to just issue a standard termination of month to month tenancy which requires 30 days.

I would be curious to see how this plays out in the end.
