The Garn Act excluded some transactions (prohibited restriction of them) that would thus be allowed under the California and Arizona law against restrictions: (1) the creation of a subordinate lien (2) transfers by death of a joint tenant (3) grant of a leasehold of no more than 3 years (4) transfers to certain relatives; (5) transfers to an inter vivos trust in which the borrower remains the occupant of the property.
