If it is left dirty or beat up, then she will have to pay damages out of her security.On the other hand, if she is cooperative and very neat by nature, you may benefit more by showing the house as occupied.

Can someone tell me if a creditor (lender) files a Motion for Relief From Stay in a bankruptcy, does that mean the debtor (property owner) is now liable again for the debt (credit being further damaged, lender still attempting contact with debtor, etc.)?

Aaron, there is not enough info to post a great response, but here are my initial thoughts.Always fix critical items first and cosmetic items last...anything that can cause additional damage and expenses needs to be adressed first.

All 4 pretty much have the same issues, flooring crappy, appliances not working or barely, siding rotted out, interior doors missing or badly damaged, all need painting and sheetrock repair, I could go on.

But really, if they've been good tenants and you don't have any vacancy and they don't have any actual damages you need to fix between the two tenants, I'd probably give the deposit back, or at least a portion.

This is too much brain damage for residential properties, 10% of the purchase price is customary as an option price, being more you'll get into issues of a disguised sale so a tad less is better.What both of you are suggesting is trying to sell at an unknown future value, in that case now is not the time to do an option.

Worst case, you should get a set-off of the amount of unpaid rent against any damages the judge finds you owe (which don't sound significant).
