I thought it cleared all liens and judgements on the property but the title company is now asking me to see if the seller has an owners title policy to clear previous owners judgements.I asked them is it necessary if im getting title insurance.

I believe if that is included, if they do not pay as agreed you can file the promissory note with the court and bypass the small claims process to sue them and it basically acts as a judgement you can enforce, I believe.If you can't collect from the parents, you could also sue all of them in small claims court if they are all named on the lease as tenants.

In the state of Florida, I was always told unless specifically shown a legal in a judgement for a property, personal judgements like credit card, car loans, gym membership judgements cannot encumber real estate.
