Do we have to disclose this to the lender, either at the time we convert to a rental or even up front when we apply for the HELOC?

There was a finished build in LA where the certificate of occupancy wasn't release because of these exact obstructions even though the build went according to approved plans.

They didn't have to, so that is a credit to them, but even so we are not likely to purchase any more properties from them.
