In this case I wouldn't be uncomfortable with this at all except to make sure it doesn't have tax consequences like somebody else mentioned and to make sure that you're following state law on whether or not you need to put the money in a separate account and take one month out at a time or if you can just take the whole amount at once.

If they want to fight it, offer to "settle" with them for the amount of the rent they didn't collect.I'd do it just to make a point that they can't get away with just dropping the ball like that without a consequence
