Seller knowingly misrepresented, so it sounds like outright fraud to me. 

Advise that you need the tenant relocated from your property immediately for a whole host of issues and that you would like for a Notice To Quit to be served on the tenant immediately (in my area, the caseworkers can issue the Notice by email and have them out in 3 days) and offer to provide them with the details should they wish to file a fraud claim against the previous seller. 

Also on the comps, there is an identical duplex right next to mine that was showing appraisal $32k below mine.

I’m not suggesting to commit fraud but I’m just keeping it real, that if that dynamic changed it’s a good loan but hard to get offers accepted with in this market I’ll admit.
