In order to foreclose in a judicial state it must go through the courts and you can easily file a response to the complaint showing the lien is not valid.In non judicial states it would be the same thing, you could respond to the trustee saying lien is not valid and they would have to provide proof of the original note you signed and notarized as well as the recorded deed of trust.

My response to this is if the individuals are hesitant to invest in the first place, the likelihood of that same individual waiting to invest later and then pick an investment with a higher risk profile (which often comes with investments that yield higher returns) is possible, but maybe not as likely.

Just want to make sure you ask about prepayment penalties usually required but not always.Good tip to remember is prepayment penalties are not always a "Bad" thing and they help get a lower rate.
