Are home owners losing their properties to fake foreclosures?

I read how easy it is for scam artist to file fake papers with the county court clerk in order to foreclosure on properties. They say that these papers are available on the dark web. What protection can home owners have against this?

This is like worrying about an asteroid hitting your house. Nothing you can do but someone cannot fake foreclose on your home. In order to foreclose in a judicial state it must go through the courts and you can easily file a response to the complaint showing the lien is not valid.

In non judicial states it would be the same thing, you could respond to the trustee saying lien is not valid and they would have to provide proof of the original note you signed and notarized as well as the recorded deed of trust.

I think you are mistaking fake foreclosures with the commercials we hear about for title theft. Faking a foreclosure would require thousands of dollars in fees, months (if not years) of time, an incredible degree of knowledge of state and national foreclosure rules and procedures and balls the size of a house to expose one's self to the prosecution that would more than likely result from the fraudulent action. You don't foreclosure privately. its a public action for a reason.

Foreclosure is a lengthy and expensive process.

The scammer would have to be present at several court hearings over the course of a year or two in addition to filing the proper paperwork. The lender and the homeowner would have to be notified and involved in the court proceedings and there needs to be proof that the homeowner and lender were notified several times. It's unlikely that a scammer could pull it off with some documents copied off of the web.

I don’t believe it is that simple. It is a lot more complex than someone filing paperwork at the county. There are lawyers and lenders involved. The homeowner will probably get tons of calls before the actual sale date giving him an opportunity to catch it early.
