I can force the value of the building up by getting the rest of the rents to 2k but even then only let me use a cash out for property improvements.

Wow, you cannot force him to sign an addendum so (Maybe) he can choose whatever date he wants, such as February 23rd 2050....and live there rent free until the lease expires (???)

But there are some loans that are callable as due in full when no longer owner occupied; if you have one of those (check your loan docs), then you might be forced to refi if/when the loan is called.
