but yes if EM was due and it never came in contract has expired. although in that state keep in mind NO EM is needed to be in contract.. like in Oregon and probably WA  to be in contract there has to be consideration. not in Indy.. 

EM is suppose to be held by a nuetral 3rd party only- Title Co / Closing Attorney or the realty brokerage.No real estate agency with a FSBO, so should be with the closing agent.
