I have a bit of pickle I've been thinking over and wanted to know if anyone out there could kindly offer some guidance..I have 3 properties as detailed below..

The home now is in need of some big ticket maintenance items like roof, fencing, and deck.

I see I made a major deficiency in purchasing my current property with the age of the key items, e.g. gas furnaces, water heaters, washer/dryers, refrigerators, stoves, plumbing, electrical, etc.

In court you just explain each item one at a time--eg. show photo proof of what the carpet looked like when they moved in and when they left, the bill to clean it and a photo after it was cleaned, etc. 

A home would have to have all cap ex items taken care of very recently for me to only account 5% for it. 

It sounds like all of your items are small repairs that will each individually be under the $2,500 deminimus amount.
