According to this article, in Florida only the landlord signature requires 2 witnesses.

You haven't witnessed this person smoke inside, so why not find a reason to go over there (maybe to change the smoke detectors/batteries) and check if the whole home reeks of smoke.

If worse comes to worse perhaps you could get the tenant who complained about him to sign something witnessing what she saw, and save it in your files, if you do need to reject based on that.

Hi @Andreas W., It is always best to go with a Qualified Intermediary that does nothing but administer 1031 Exchanges. 

If you actually witness him causing damage, then you could at least make a police report, and have good cause to terminate/non-renew.

After admitting over the phone and in person (along with witnesses) she is now claiming over text message that she never turned it off.Unfortunately I will likely have to pursue eviction. 

We were lucky in that a family member purchased and built their home in the same community and we were able to witness the entire process as we visited yearly.

Ensure you have a things witnessed and notarized if you have to.

You won't get a good deal, no one will want to deal w/ it and if you're chasing flips you likely going against all cash offers.
