There are ALWAYS unintended consequences to these kinds of laws/rules and the hubris of the govt to believe they can perfectly legislate so as to avoid anyone being harmed/hurt is what will ultimately be 'our' collective downfall. 

Under the topic "Build, preserve, and retrofit more than two million homes and commercial buildings to address the affordable housing crisis" the text from FACT SHEET: The American Jobs Plan says: Eliminate exclusionary zoning and harmful land use policies.

No harm no foul yet, but be sure to stick to the lease.

If you are planning to use the cash long term, such as funding a down payment, then there is no harm in doing a cash out refinance. 

Don't do anything that will in the end cost you more money and place you in harms way.
