I would ask your lender to review the situation before you make an offer on a property.

If you keep the rental in your own name you will need to change to a landlord policy you will also need a professional review of your primary policy and if you don't have a personal umbrella policy you'll need one of those too.

I would contact a good tax attorney at this point so that they can review everything that you have, including agreements with the silent partner, how the actual reporting was carried out, etc., in order to determine how to best answer your end questions above.

During attorney review you can add in that you may assign the contract- that may not fly with them, but if the property has enough problems or the Agent is unexperienced you may get away with it.
