The Hold Harmless won't do you much good if your seller takes bankruptcy or doesn't have a pot to spit in or a window to throw it out of.It might be better to buy into the existing LLC, divide the property under that Operating Agreement and take care of the transaction inside the LLC.

She can always stop it by paying you for the rent and filing fees.But if you were to use her deposit and then she doesn't come up with January rent, you'll have no leverage and she'll have no incentive to keep the place neat, when she moves out voluntarily.

In this particular deal though as is the case with so many hands in the pot - I couldn't get word across to the seller (through the web of realtors) that he needed to have a separate company do the testing before and after, otherwise how do we know the mold is actually remedied?

If the HOA is ran down with a bunch of vacancy you can expect to pay or eventually pay higher HOA fees from the lack of owners paying into the pot.

@Ryan Pomerening you still need to contact that lawyer about the answer to this question as this is no legal advice, just an opinion of what I would do.I would get a copy of the existing lease and bring that with me to an attorney and ask the attorney for an agreement to voluntarily end a lease early.
