Unbelievable.Now we have another court date.My lawyer is concerned that the tenant will show with fake documentation and the judge will hold this over for trial where each side has time and the opportunity to call witnesses etc.I will obviously win in the end , but this tenant is willing to do whatever he can to live for free.

Dont ever go to the property without a witness and have a constable with you when you are changing the locks once the eviction is complete.There is a chance he will leave once he gets the letter from your attorney.

There are other ways to probate an estate, but these are the most common in trying to sell a house out of an estate.Each attorney will be different, but the cost will be driven by how good your facts are (how long ago H died, # of kids from marriage, kids from outside marriage, # and availability of witnesses to family matters, etc.).
