1) You'r fishing in the wrong pond if you're trying to wholesale off the MLS.2) If you're buying off the MLS you will be using the standard realtor agreements, and they'll likely reject your offer with any kind of escape clauses, other than standard inspection times.

I prefer to fish in the larger pools of deals.  2nd's are a very small pool of potential deals and currently there is little inventory and they are overpriced.1st's are easier to raise capital for.
