If you plan to use it as a second home you must reside there for a portion of the year (varies depending on Fannie, Freddie, FHA, etc) and it must be available (i.e. not rented out) for more than half of the calendar year.

In some states, you have to file notice for eviction in the same calendar month as the violation.
