@Josh Levinsky, this is a great question in that both sides can be vigorously defended as the right path!

Joshua, I have to defend you a bit and rightfully so I think.

I've been trying #2 in earnest for about a two years but it's difficult because tenants bristle to defend themselves and wiggle out, lean on the local tenant advocacy groups, etc.

You also have Wyndham/Windsor Palms, Indian Creek, Rolling Hills, Champions Gate, Formosa Gardens, Windsor at Westside, Calabay Parc...............

Note that we manage our properties ourselves so having a property manager defending a tenant is disturbing at best. 

Only once did they ask me to come in to defend my claim and that is the year that I chose to abandon my request as I suspected I would lose the hearing anyway.And, just to show that assessed value and market value can be unrelated, I was always able to refinance and ultimately sell my last home for well above the tax value that I could always get the county to agree on.

So instead of chatting REI, I usually end up off-track defending my plan to stop churning the 9-5 wheel!

I'm certainly not going to waste my time defending this strategy further. 

Buyer shall carry, or Buyer shall require anyone acting on Buyer's behalf to carry, policies of liability. worker's compensation, and other applicable insurance, defending and protecting Seller from liability for any injuries to persons or property occurring during any work done on the Property at Buyer's direction, prior to Close Of Escrow.

For sure these’s a fraud aspect involved- but prosecutors don’t want to spend time filing charges of criminal fraud in what’s more probably civil fraud cases- and lawyers only take cases (on contingency) where the potential judgement is large enough AND  the defendant has the means to pay.
