Justin Cutler its a common misconception that only an actual transfer of title violates the DOS clause.

There can be many issues that arise from either theory, one misconception about title theory is that a lender can end up with legal title after a default and simply own the property with all the bundle of rights.

(No legal advice this is just based on my experience and understanding of some misconceptions of what is provided by SCRA to many in the service)
