Since Congress has never passed legislation providing a bright line test between 1099 and W-2, the IRS uses fuzzy rules favoring W-2 over 1099 when they have doubts.For example, if you want perceived freedom, choose 1099.

I'm not worried about renting this if we have turnover, but I'm just trying to be aware of ways to get to win-win outcomes if we see additional legislative action on eviction moratoriums due to COVID. 

Until the federal Supreme court addresses some of these issues, states are likely to enforce more legislation that can double tax some income.

My local Landlord Assn. in Maine has expressed interst in sponsoring legislation to make "theft of services" laws apply to tenants who don't pay their rent.  

Where are you following the legislation/updates on that?

Of course they can, but that is not what legislators are concerned with.

So the moratorium opens the door for legislation to compensate landlords for lost rent.Think of it like this, state and local govt.
