I was just subpoenaed as a witness for a commercial landlord/tenant dispute.

I personally witnessed some of the neighbor's bad behavior prior to leasing the property but I attributed the behavior to the idea that the house was empty before I bought it and that he would respect the fact that someone was now living next door. 

I have seen summary ejectment cases lead to actions against the plaintiff... so I have witnessed in Wake county court similar events that you post about, although I was not the plaintiff. 

Ethically it would be reasonable to bring another agent in from your firm, or even another firm, to witness discussions and provide an unbiased opinion on what the seller could reasonably expect to get if he lists it on the MLS - that turns you into just a buyer if he doesn't want to list it, and the listing agent if he does want to list it after hearing his realistic options from a disinterested party. 

Well no but it's not a landlords job to play Sherlock Holmes to pick up petty criminals and iv never seen a lease where a landlord swears not to testify as a material witness against their tenants.
