Yes, if you have a claim against the tenant (additional unpaid rent, unreasonable damage), you should file the defendant claim. 

He admits he could easily take many times over the number of listings he takes but he would rather spend more time on the phone finding a good listing then running around meeting with every potential seller that will give him an appointment and allow him to list their home for some unreasonable price.

If you tack on $25 a day for 20 days, most courts will throw that out as unreasonable.
