I have made the county aware but am waiting for judge to decide if sale will go thru by I am worried since they dont guarantee clear title they are going to deny my claim for refund.

IF you have paid the seller an EMD and are forefeiting it, wholesaling and assignment fees, are considered legit in your market and you get a friendly judge.

I would charge them for every possible thing, knowing the judge will likely reduce what you can actually claim and you'll end up below the $10,000 limit.3.

However, I don't know if a judge would allow you to evict over it.If they are withholding rent illegally, proceed with the eviction and be done with them.

@Atul Mohlajee not sure who your attorney is, but three of our attorneys approved our automatically renewing lease that requires tenant to give proper Notice so it does NOT auto-renewal.Michigan law also allows any length of Notice requirement, ours is 60 days.That aside, a judge can rule however they want, forcing the losing side to go through an expensive appeal process.Regarding the 1.5 SD, they are legally allowed to deduct any damages, then apply the rest to outstanding rent.My opinion is that the PMC should only be able to charge:1) Rent + lease utilities until a replacement tenant is found (Michigan statute)2) Whatever the lease contract states

If I can't find previous owner (building was forclosed - so seller was the bank), and all my efforts to find and talk with him have failed - why would the judge believe me over tenant?
