When we were hosting full-time on Airbnb here in Denver, we had someone break a leg on a couch.

There is a BP team member who was interviewed on the podcast I work for, I believe it was @Craig Curelop, he short term rents all BR's and sleeps on the couch of his own home!

Do these guys not want to get off the couch unless they are making $100K here in NY?

looks like you no longer have this issue.But in the future if it happens again what's been mentioned so far - screen the new tenant, fill out application form, collect app fee, and have all existing tenant sign.IN ADDITION, make sure the existing tenants and new tenant understand, and include into the addendum if necessary, that all claims, damages and deposits are shared by all tenants from this day forward.That means if you see a broken window and need to charge them for repairs tenant C can't say oh it's broken before I moved in.Or if tenant B moves out and six months later you charge a deduction in the security deposit on a hole in the wall behind the couch he says the hole wasn't there when he moved out so it's not coming out of his deposit.At the end of the lease when you refund the deposit it will be a check to "A B and C" jointly regardless of who might be there or not at the end of the lease.

I have a few suggestions that I have done to learn as much as possible here on BP:Listen to the podcasts when you are driving/ relaxing on the couch, etc.

I hear:"Alex, you're so poor that the debt services on your cheap, embarrassing houses can be afforded with couch coins and no additional underwriting is needed"#semantics ;)

the issue at hand is a question of whether the property is considered abandoned or a hold over. this issue would vary slightly state to state, and would most likely fall on the judgement of the judge who presides over the case. however, if nothing has been removed from the apartment, I doubt any judge would call it abandoned, perhaps if all utilities are turned off you may have an argument. if everything is missing except garbage and maybe a couch, then you are probably looking at abandonment, but from the way the story reads, I doubt any judge would be happy with what the landlord did.
