The lease is something to fall back on, even though you may be friends and you've initiated the hand shake agreement.

I would think that your hold harmless would shake off such claims together with the proper disclosures.Are you using a real estate attorney, or one that specializes in civil litigation?

If you don't think you've gotten a fair shake by the listing agent why not contact his broker as a first step.
