I was thinking that I could also possibly (if they agree) draw up my own new lease with all 4 names and the new amount but was hoping get some feedback on the current clause since it is a bit gray.

My question is should I be up front with them about what I’m doing and how I’ll be pocketing close to 80,000 if all goes as planned, or will they feel some type of way about that it seems like a gray area like I’m taking advantage of them but they are still getting a great under their budget deal. 

Everything is dated after 10 years so might as well do the lakeshore pecan or castle gray in laminate for $.79 vs 3$ sq ft and have it be dated in 10 years.

Where's the gray area, do you know of resources where I can find a little more info on this and what would define marketing the property versus the contract?

I'd recommend discussing lending guidelines with a good loan officer so you can feel confident about the limitations of the loans you're using.I've found that for a lot of these loan type of conversations there are gray areas and nuances so it's best to figure out what strategy you want to go after and then work with a trusted lender team to do it the way that works for you while avoiding risk of mortgage fraud or having a lender call your loan due.
