There are many unfinished projects (promises made by MGM) around the casino, that are now gaining traction as MGM President Bill Hornbuckle and Mayor Sarno had a recent meeting to review the host community agreement -- the Sarno administration was vocal about MGM not fulfilling its promises to the City.

If the buyer did not close or fulfill the obligation then seller could potentially sue for damages - see this more often in wholesale deals.

If it were me, I would make the argument that the agent has not fulfilled their obligation to bring a buyer for the property and is therefore not entitled to a commission.

They typically build life-long seller-lead businesses in their market and if you work with a few of the top-agents in multiple locales, you can likely get a good stream of leads going (constant new-business with various owners who might be interested).
