Memorandum-Buyer put on property, does he have to sell at original contract price
TREC sale contract signed by buyer and seller.
Buyer put a Memorandum on the property clouding the title stating the date of the contract. (Six days after signing of the contract and way before closing date.) Unknown to the seller. Seller just found out 2 months later.
Seller never cancelled the contract and neither did the buyer. The closing date of the contract has passed now due to some issues. Seller thought buyer was no longer interested.
Question: If you still go with the buyer that put the memorandum on the property, do they have to honor the price of the original contract that they put the memorandum on?
