But, if I hold to those same standards and expect a replacement tenant with similar qualifications, can the tenant accuse me of not making a reasonable attempt to re-rent?

I see accusations of some type of fraud, and the inability to enforce this scheme at some point in the future, IF you were able to slip this by in the closing.
