I have adequate proof of photos of garden to show before and after, but still a little worry about court as Washington is such a liberal state that doesn't have a fair legal system to protect fairness and justice, but strongly leaning against protecting tenants.Could you share with me any advice how to go through small claim court in Washington, specifically in Seattle?

While there is little definitive authority on the holding period, in one private letter ruling, the Internal Revenue Service has stated that a minimum holding period of two (2) years would be sufficient to meet the Qualified Use test, and a number of court decisions have been handed down that have also taken the same position (although they have been somewhat more liberal than the Department of the Treasury and the Internal Revenue Service).The amount of time an Investor holds the property is not the only factor the Internal Revenue Service will use to determine whether the Investor had the appropriate intent to qualify for a tax-deferred like-kind exchange, but it is extremely important.
