You were right to bring it to the title insurance company.My advice: find a kick (rear) real estate lawyer to investigate whether (s)he'd take it up as a case AGAINST THE TITLE CO for you.

I’ll use an analogy - if you want to make a lot of money why don’t you just become a doctor or a lawyer?

If you really feel something this simple needs to be fleshed out so much, have the client hire a lawyer to write up these contract terms. 

@Ayyoub Reza   There are a number of places to get agreements but make sure you get one that is current and state specific (here, legal zoom, a lawyer, real estate association ) Read your HOA bylaws what does it require to be included.

Do you know that in some states title insurance companies pay referral fees to lawyers who refer them business and are not required to disclose it?
