It might be an overkill if you use A/E contract on a rehab, and your contractor might not sign it just for the mere reason that it is too lengthy, some cheap GC are like only handyman with a 2 guy support (most investors are using this type of GC) to get a cheap price and for a deal to work.

Technically speaking the 1031 is merely an assignment of contract rights to the intermediary and we specify that the deed pass directly from seller to buyer.

(And yet, as soon as Turn-Key companies snap them up for the same $25k as this one, put say $5k into the rehab, then offer a years rental guarantee to Californians or Australians at a sale price of a "mere" $70k - those same banks fall over each other to lend 80%)!!!
