I'd talk to a competent estate planner.  

A little about the land it is located in Oxford NC, residential I have talked with city planner she informed me that I could build 2 posibly 3 duplex units, definitely 2 on the land. 

Whether you need an LLC now and the form of LLC to use is a discussion you should have with your CPA, your attorney, your estate planner, and your insurance agent -- preferably with all in the same room at the same time.

To add to that problem, both the City and County planners are very Liberal and DO NOT want cookie cutter neighborhood developments built.
