Hi Nadia,If she bent the key trying to turn a non-turning lock (not her fault) WD-40 the lock or replace it as defective and you pay.If she bent the key using it as a screw driver or prying tool she pays.I have twisted off a key in a defective lock before, it's easy to do.I like the Schlage Grade 1 deadbolts with a Hall and Closet lock set replacing the front door knob (so no lockouts).Good Luck!

From what I can tell, Missouri is a "material defect" disclosure state... and an HOA is not a material defect because it is public information.

I would recommend waiting to get the appraisal back and either appealing it or asking for a new appraiser and note material defects in the report such as wrong square footage, wrong house type etc.

(4) Pay for local MLS dues.Drawback: Disclosure - As a licensed agent you must disclose every single material defect your investment properties have (or had...and repaired) if you plan to sell them.

If the court is persuaded the change is sufficient to nullify the restriction then all the named parties right to enforce is extinguished.I've had attorneys representing property owners ask who needed to be named in such a suit so that when concluded the underwriter would authorize the issuance of a policy w/o exception for the restriction.While many title people consider a Letter of Indem a panacea for a defect in title, more important in my opinion is would an informed and knowledgeable purchaser or lender, close on the purchase and loan knowing there was a risk of future litigation.

Zoning issues don't constitute as a defect, so it doesn't have to be disclosed at least in the auctions I have been a part of.

If she is getting fungal infections from what she claims is the tub, let her produce scientific evidence that it is because of that fact and that there is some specific defect why the tub cannot be properly cleaned.

@David Roe Nobody can answer these questions or provide much in the way of guidance without seeing the precise contract language addressing financing, title defects, deposits, etc. and any communications that may have modified the original agreement(s).Also what did the seller sign on 3/31?

While it's all public information, it's probably best to find someone who knows what to look for and who to contact in the event that there is a defect with the title.
